Situation 1

You have been appointed as chair of a three-member DB and you travel to your first Site Visit. Having arrived, you watch the Parties entering the meeting room and you recognise a person with whom you had a legal battle a few months ago for non-payment of your invoice. But you did not realise he is now part of the employer‘s personnel.

What do you do?


Situation 2

You have just finished a three-day visit on a remote project, some 5 hours drive from the airport. On your way there, suddenly your driver stops the car and you notice that the project‘s Engineer walks to your car, opens the door and gets in, fully expecting to hitch a ride to the airport.

What do you do?


Situation 3

As the chair of a standing DB with retainer you receive an e-mail from the Contractor with no copy to the Employer requesting you to visit the Site in three-weeks‘ time for an important construction activity they wish you to be present for. Unfortunately, you realise that in that week you are supposed to be in New Zealand for the birth of your first grandchild.

Situation 4

Your appointment as a DB is coming to an end in two months‘ time. The project was a success and the parties are happy with your involvement. The Employer sends you an e-mail with a copy to the Contractor requesting you to make a proposal to conduct a series of workshops for staff members in the employer‘s back office starting a week after your appointment ends.

 What do you do?


Situation 5

During a Site Visit an issue comes up that seems to be contentious. It relates to the interpretation of a specific contract clause. During the debate, the Contractor turns to you and says: „So, what is the correct interpretation?“
